Acceptance of Terms

By creating an account, accessing, Browse, or using the Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms. Keenchess reserves the right, at its sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. Your continued use of the Platform after any such changes constitutes your acceptance of the new Terms.

Eligibility

• Age Restriction: The Keenchess Platform is intended for users who are 13 years of age or older. By creating an account and using the Platform, you represent and warrant that you are at least 13 years old.

• Monetary Features: To access and utilize any earning potentials of the Platform, including participating in trivia games with payouts or prize tournaments, users must be at least 18 years of age or older and must successfully complete our Know Your Customer (KYC) verification process (as described in Section 4).

• Jurisdictional Compliance: You are solely responsible for ensuring that your use of the Platform is in compliance with all applicable laws, rules, and regulations in your jurisdiction. Keenchess makes no representation that the Platform is appropriate or available for use in all locations.

Account Registration and Security

• Account Creation: To access certain features of the Platform, you must register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

• Account Credentials: You are solely responsible for maintaining the confidentiality of your account login credentials (email and password) and for all activities that occur under your account. You agree to notify Keenchess immediately of any unauthorized use of your account or any other breach of security. Keenchess will not be liable for any loss or damage arising from your failure to comply with this section.

• No Multi-Accounting: Each user is permitted to maintain only one active account on the Platform. Creation or use of multiple accounts (multi-accounting) is a violation of these Terms and may result in account suspension or termination.

Know Your Customer (KYC) Requirements

To access any earning features (trivia games with payouts or prize tournaments), you must undergo and successfully complete our KYC verification process. This process requires you to:

• Submit a valid government-issued photo ID.

• Provide a real-time selfie for identity verification.

This rigorous KYC process is mandatory to verify your identity, prevent fraud, comply with Anti-Money Laundering (AML) laws, and ensure the integrity of our earning features. Failure to complete KYC will prevent you from participating in any activities that allow you to earn money. Non-compliant users can still access non-monetary platform features.

Acceptable Use Policy and Prohibited Conduct

You agree to use the Platform only for lawful purposes and in a manner that does not infringe the rights of, restrict, or inhibit anyone else's use and enjoyment of the Platform. Prohibited conduct includes, but is not limited to:

• Fair Play Violations: Cheating, using chess engines or any unauthorized assistance during games, or manipulating game outcomes.

• Abusive Behavior: Engaging in any form of harassment, verbal abuse, hate speech, or offensive conduct towards other users or Keenchess staff.

• Multi-Accounting: Creating or using more than one Keenchess account.

• Fraudulent Activity: Any attempt to defraud Keenchess or other users, including fraudulent transactions, identity theft, or false claims.

• Unauthorized Access: Attempting to gain unauthorized access to our systems or data.

• Malware/Viruses: Uploading any malicious code.

• Data Mining: Using automated tools to extract data from the Platform.

• Violation of Laws: Engaging in illegal activities.

• Disruption: Interfering with the integrity or performance of the Platform.

Violations may result in account suspension, earnings forfeiture, and legal action.

Trust Score

Your 'Trust Score' is a public metric reflecting your adherence to fair play and community standards. It is based on:

• Compliance with Fair Play policies.

• Incident history (cheating, abuse, multi-accounting).

A high Trust Score contributes to a healthy community. Keenchess may adjust your score at its discretion.

Monetary Features, Keens & Memberships

• Keens are in-platform tokens for participating in trivia games and tournaments.

• They have no real-world value outside the Platform.

• Purchases are capped at $50 per user/week to comply with AML regulations.

• Memberships can provide Keens and other benefits.

• Users who pass KYC can convert earned Keens to real money (minimum withdrawal: $10).

• Gateway fees (~$10) apply. No refunds for Keens or memberships.

Tournament Rules

Participation in tournaments is subject to specific rules and guidelines.

Violations may lead to disqualification, prize forfeiture, and penalties.

User-Generated Content

• You are responsible for all content you post or transmit.

• You grant Keenchess a license to use and display your content for Platform purposes.

• Do not submit illegal, offensive, or infringing content.

Intellectual Property

• All Platform content is owned by Keenchess or its licensors.

• You are granted a limited, non-transferable license to use the Platform personally.

Disclaimers

The Platform and its services are provided "as is" without warranties. Keenchess disclaims all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.

Limitation of Liability

Keenchess is not liable for indirect or consequential damages.

Maximum liability is the greater of $100 or the amount you paid in the past 12 months.

Indemnification

You agree to indemnify Keenchess for any losses resulting from your Platform use or violations of the Terms.

Termination and Account Suspension

Keenchess may suspend or terminate your account at its discretion.

Upon termination, your rights to use the Platform end.

Some sections of the Terms survive termination (e.g., indemnification).

Governing Law and Dispute Resolution

• These Terms are governed by the laws of Delaware, United States.

• Arbitration will be held in Delaware under AAA rules.

• You waive rights to join class actions or representative claims.

Miscellaneous

• These Terms and the Privacy Policy are the entire agreement.

• If any term is unenforceable, others remain in effect.

• Keenchess may assign these Terms; you may not.

• Waivers must be explicit.
